Our Company Policy

READ CAREFULLY – PARTICIPANTS MUST UNDERSTAND AND AGREE TO TERMS AND CONDITIONS

In exchange for the participation in the activity of kayaking organized by Clearly Companies, Clearly Tahoe LLC, or Clearly LLC and/or use of property, facilities, and services of Clearly Tahoe LLC, I agree for myself and (if applicable), for the members of my party, to the following:

LIMITATIONS: Please review the following limitations prior to making a reservation. Age and weight restrictions do apply. All participants under the age of 18, must be accompanied by an adult (18+) at all times during the activity. Children under the age of 12 must ride in a boat with an adult guest (18+). All participants must be over the age of 5. Guests under the age of 18 must have a parent or legal guardian present to sign liability waiver. Children will be defined as ages 5-11 and be priced as children. Youth will be defined as ages 12-17 and will be priced as youth. All guests must be physically and mentally capable of participating in described activity. Participants must agree to disclose any knowledge of medical history that might affect his/her or their dependents ability to participate in described activity. No more than two occupants are permitted in one boat. Guests will not be permitted to share seats during the activity. Total combined capacity must not exceed a weight of 375lbs. RESPONSIBILITY OF PARTICIPANTS: It is the responsibility of our guests to review and agree the following limitations and policies prior to booking. Participants must provide their own transportation to and from scheduled activity site. Participants will be responsible for parking and or any or parking or entry fees associated with parking or entry to a designated activity site. All participants must agree to and sign a liability waver provided by Clearly Companies, Clearly Tahoe LLC, or Clearly LLC in order to partake in scheduled activity. If participant is a minor, a parent or legal guardian must be present to sign waiver on behalf of the child or youth guest. PHYSICAL/MENTAL REQUIREMENT OF PARTICIPANTS: All guests will be required to paddle at a reasonable pace with occasional breaks during the duration of the tour. Participants may be required to the water prior to boarding the boats. All participants must be capable of entering and exiting the boat without assistance. Guests should be prepared to swim a short distance if necessary. DRESS CODE: Shoes and sharp objects must be removed or covered prior to entering the boat with the exception of neoprene or rubber water shoes. Guest should be prepared for the possibility of getting wet and should dress accordingly. It is recommended to wear sunscreen, hats and protective clothing when exposed to the sun for an extended period of time. RULES AND REGULATIONS: Guests must listen to guides and representatives of Clearly Companies, Clearly Tahoe, LLC and Clearly LLC during safety speech and during of activity. Participants will be required to wear a US Coast Guard approved life preserver provided by Clearly. All personal life preservers must be inspected and approved by our Clearly Tahoe staff. Life preservers must be worn at all times on the water or near the water. Guests are responsible for their own safety pre and post activity as well as during scheduled breaks. No alcohol, drugs or controlled substances of any kind will per permitted on the kayaks. No smoking will be permitted during tour. No weapons of any kind will be allowed in the kayaks. Personal items should be kept in dry bag or kept in a safe environment. Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC prohibits any kind of container or bag that might scratch or damage the kayaks in any way. Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC is not responsible for any loss or damage to personal items resulting from participation in described activity. Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC reserves the right to refuse service to any participant at any time for any reason before or during activity without refund. The employees or representatives of Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC may refuse service if any participant seems potentially harmful to themselves or others.

PET POLICY: Pets may be permitted on select tours at select locations with advance reservation and approval for a $30 pet fee. Guests must submit an “Animal Request” form prior to scheduled activity and allow 24 hours for approval. All pet policies and fees apply. Companion animals must not exceed 20lbs for shuttle transportation. Dogs exceeding 20lbs require management approval and may be subject to additional instruction and limitations. Approved pets may be permitted to accompany an adult guest (18+) on select tours. Animals will not be permitted in a boat without an adult passenger. All pets must be well behaved and restrained during the entire experience on no more than a 6ft leash. Guests opting for complementary shuttle transportation will be required to transport their pet in a pet carrier not exceeding 20in (L) 18in (H) and 16in (W). Guests with approval of larger pets exceeding 20 lbs. must provide their own transportation to and from the scheduled launch site. Guests agree to take full responsibility of their pet during as well as pre and post activity. If a service animal is necessary, arrangements can be made. Any special arrangements involving service animals or medical needs must be made at time of booking or a minimum of 24 hours prior to scheduled activity. FOR THE SAFETY OF OUR GUESTS AS WELL AS THE SERVICE ANIMAL, TOUR OPTIONS MAY BE LIMITED. RENTAL POLICIES: All Renters must be over 18 years of age and show valid government issued ID and credit card at time of check-in. Participants under the age of 18 must have a parent or legal guardian present at all times during the activity. Renter will be responsible for any and all bodily injury to members in his/her party or property damage that may occur while rental items are in the possession of the renting party. It is the responsibility of the renter to review complete Company Policies and agree to the terms and fees prior to making a rental reservation Failure to meet rental requirements will result in non-refundable same-day cancellation and be subject to our same-day cancellation policies. LOST, STOLEN OR DAMAGED ITEMS (Applicable to Rentals only): There will be a fee of $60 or more for any major scratches to clear kayak. Renter shall agree to take full financial responsibility for any lost, stolen or damaged items included in rental package. Replacement costs are to be agreed upon as follows: Clear Kayak: $1,800, Seat: $55, Paddles: $50, Life Preservers: $35, Dry Bag: $30, Cooler Bag: $20, Pump: $30. ADDITIONAL RENTAL FEES: Extending rental time without prior reservation may result in a charge of $60/hour per boat. Additional fees associated with alterations to initial reservation, late fees or damages will be automatically charged to Renter’s card on file.

CANCELLATION POLICY: TOUR CANCELLATION: Cancellations must be made by phone no less than 2 weeks prior to the day of scheduled activity to receive a refund. Cancellations made more than 2 weeks before scheduled activity may be eligible for a 50% less a $20 cancellation fee. Cancellations made less than 2 weeks prior to the start of scheduled activity will be non-refundable.
AS OF MARCH 15th, 2020 DUE TO THE STATE OF CORONAVIRUS AND POSSIBLE IMACT ON SCHEDULED ACTIVITIES Clearly Tahoe encourages guests to cancel if any member of their party feels ill or has any potential health risks that may impact other guests, staff members or the general public. Cancellations made within 48 hours of scheduled activity will be subject to a full refund in the form of a gift certificate applicable to any future trip at any Clearly® location.

RESERVATION CHANGES:
Reservation changes made within 48 hours of scheduled trip may be possible but not guaranteed. Reservation changes altering the number of boats in a reservation, tour type, activity day or time will be subject to a $20 reservation change fee. No refunds, credits or re-scheduling will be permitted less than 48 hours prior to scheduled activity. Reservation change requests can be made to reservations@clearlyadventureco.com but are not a guaranteed. BOOKING ERRORS: Errors in scheduling or cancellations made within 24 hours of booking may be eligible for a full purchase refund. Cancellation or issue resolution request must be made by email to reservations at reservations@clearlyadventureco.com within 24 hours original booking was made but no less than 48 hours prior to scheduled tour date. 

PRIVATE TOURS/RENTALS: Clearly Companies, Clearly Tahoe LLC, and Clearly LLC offers a variety of private tours and rental options. Private tours are subject to a 25% private tour fee at the time of reservation. It is the responsibility of our guests to ensure their eligibility to partake in specific tours. Failure to validate eligibility at check-in will result in same-day cancellation of the tour and be subject to our “Same-Day Cancellation Policies”.

GROUPS ACTIVITIES: Clearly Companies, Clearly Tahoe LLC, and Clearly LLC specialize in private group activities with possible delivery to your location. Reservation Requests must be made within 48 hours of scheduled trip for groups of 10+. Guests are responsible for any external fees associated with entry to or use of requested venue including but not limited to lodging, site fee, parking fees or coordination fees. GROUP DISCOUNTS: Groups of 10+ guests will automatically receive a private experience at no additional fee on any of our pre-scheduled activities. In addition; groups of 10+ guests are subject to a 10% discount and groups of 20-39 will receive a 20% discount on any pre-scheduled tour. Customized experiences off-site will be subject to a 25% “Private Tour Fee”. Customized tours are designed to offer flexible locations, flexible durations, flexible start time and flexible content. GROUP BILLING: Groups of 10+ guests are subject to our group billing options. Group billing requires a 50% deposit at the time of reservation with 2 remaining installments due the day of and 14 days post activity. GROUP DEPOSIT: Large groups must make a non-refundable deposit at the time of reservation. Group deposits shall be in the amount of $500 applicable to quotes exceeding $1,000 or 50% of balances amounting to less than $1,000. GROUP RESERVATION CHANGES: Group Changes made more than 14 days prior to scheduled activity will not be subject to reservation change fees. Changes made within 14 days of scheduled activity will be subject to a $20.00 reservation change fee per change. Group reservation changes may be requested until the start time of scheduled activity. Changes are limited and not guaranteed. INSTALLMENTS/BILLING: Initial deposit will be due at the time of reservation. Second installment shall be calculated and billed 14 days prior to scheduled activity and due the day of scheduled activity. Final payment will be due 14 days post activity. Failure to make final payment may result in a late fee in the amount of 10% of balance due per day after the 14th day following scheduled activity. GROUP CANCELLATION: Cancellations made within 14 days of scheduled activity will be refundable. Initial deposit will be non-refundable. Group cancellations or changes made after 14 days will be non-refundable.

GIFT CARD/ GIFT CARD REFUND: All gift card purchases are final. No refunds shall be made from time of purchase. Gift cards can be used for multiple transactions and applied to any participating Clearly location. Gift cards can be applied to online reservations or by contacting our reservation office at (530)554-4664. Gift Cards may be combined with other discounts and offers. Gift cards are not valid after expiration however, may be used to purchase an additional gift certificate prior to expiration. Gift card balance cannot be redeemed for cash. GIFT CERTIFICATES/GIFT CERTIFICATE REFUND: Promotional Gift Certificates may be applied to specific activity only. Gift certificates may only be used one time and cannot be combined with any other discounts or offers. Guests must contact our reservation office online at reservations#@clearlyadventureco.com to redeem gift certificates. Unused balance on gift certificates is non-refundable and may not be redeemed for cash value. Gift certificates are valid through expiration date only. MERCHANDISE RETURN: Clearly Merchandise purchased through directly through a participating Clearly location may be subject to a full refund within 7 days of purchase. Customer must have original purchase receipt. Merchandise must show no signs of wear or usage prior to return. MERCHANDISE EXCHANGE: Exchanges can be made within 30 days of purchase. Item must show no signs of wear or usage. Exchanges are based on availability. Products could be exchanged for item of equal or less value. Original purchase receipt must be presented for an exchange. No monetary refund will be provided. Merchandise purchased via third party companies or sponsors will be subject to third party return/cancellation policies. THIRD PARTY PURCHASES: Items ordered on our website through third party retailers are subject to the policies of that third party retailer. Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC take no responsibility for transactions through third party companies.
